Boy Suffers Brain Damage, Family Files Suit Against Pest Control Company

A Florida family has filed a lawsuit against a pest control company after they say that they were sickened by the fumigation. The entire family fell ill after re-entering their home, according to the lawsuit. However, a young boy suffered severe brain damage from exposure to the pest control toxins. The family claims that they did not properly ventilate the home after completing the fumigation, according to the lawsuit. The company told them it was safe to return to their home prior to the family getting sick.

The family alleges that the pest control company is responsible for their injuries and the boy’s brain damage.

What happened? 

The entire family fell ill after the pest control company told them it was safe to go back into their home, according to the lawsuit. The family contends that they did not properly ventilate the house after conducting the fumigation. The young boy lost motor control and the ability to speak and never recovered due to the exposure to dangerous pesticides.

Elements of negligence 

In the lawsuit mentioned above, the family contends that the pest control company failed to warn them that their home was still dangerous. The pest control company would have a duty of care to ensure that the home was safe to reenter after fumigating the house. In this case, the company failed to warn the family that the environment was unsafe for re-entry. That resulted in severe illness to the family who breathed in the fumes of dangerous pesticides, and the permanent injury of a young boy who now has severe brain damage.

However, if a pest control company tells them it’s safe to return to their home when it is not, then the pest control company would be liable for any injuries suffered by the residents.
