Cricket Club Sued After Security Shoots Guest

At any rate, a shootout at a cricket club is much more likely than a shootout during croquet. Cricket is a major sport with a fanatical following.

According to a recent lawsuit, a man was shot and killed by a security guard at a cricket club. His family has since filed a wrongful death lawsuit against the club claiming that their actions were unjustified. The shooting occurred on Thanksgiving when a large fight broke out. The family claims that the venue would have been able to successfully handle the incident had enough security been on hand. Instead, the security guard fired into the victim’s chest and killed him.

Security guards and duties of care 

If you hire someone to do security, they must be trained in criminal and civil law. If you hire untrained security and they injure someone, as the premises owner, you are liable. Alternatively, the plaintiff can also sue the security company if the venue contracted with a company. If the venue supplies their own security, then they are wholly liable. Since the allegations directly address understaffing and a lack of training, the allegations are aimed directly at the venue. The security guard is also named in the lawsuit, but when an individual is acting on behalf of a company, the company eats the bill.

While the allegations are strong, the venue can provide several defenses, including that the security guard felt that he was directly in fear for his life from the defendant. They can also blame the gun for discharging accidentally, or another individual for causing the riot that led to the fight. So, the venue is not without a defense. But the allegations do not look good and will need to be addressed.
