Traumatic Brain Injury Lawyer

A brain injury is one of the most serious types of injuries anyone can sustain. If you or a loved one recently suffered a traumatic brain injury in a car crash, slip and fall, or any other type of situation in which another party’s negligent actions caused the incident, you are likely entitled to compensation. We encourage you to take aggressive legal action by working with a traumatic brain injury lawyer at The Matassini Law Firm, P.A.

Personal Injury Claims and Traumatic Brain Injuries

A brain injury can occur in any number of situations. However, when caused by another party’s negligence, the victim is able to seek compensation, equal in severity to their damages, from the at-fault party. Examples of this include:

  • Car collisions
  • Truck crashes
  • Pedestrian accidents
  • Motorcycle crashes
  • Other traffic collisions
  • Premises accidents such as slip and falls
  • Swimming pool accidents
  • Daycare accidents
  • School accidents
  • Other child injury accidents
  • Dog attacks (TBI caused during a fall)
  • Amusement park accidents

Types of Traumatic Brain Injuries

A traumatic brain injury occurs whenever there is physical damage to the brain tissue, caused by a blunt impact, shearing or rotational forces, blood or fluid pressure on or within the brain, a penetrating injury, or lack of oxygen.

  • Concussion—Mild brain injury that usually does not involve structural damage
  • Diffuse Axonal Injury—This type of TBI occurs when the brain rotates within the skull, tearing the brain’s long connecting nerve fibers (axons).
  • Coup-Contrecoup Brain Injury—This injury occurs when the brain suffers an injury at the point of contact (such as with a window of a car, and the opposite side of the head where the brain slams against the inside of the skull.
  • Brain Hemorrhage—Bleeding that occurs on the outside surface of the brain, or deep within the brain.
  • Second Impact—A second impact brain injury refers to an injury that occurs shortly after a primary brain injury. Due to the fragility of the brain following an initial injury, a secondary brain injury is usually very serious.
  • Intracranial Hematoma—Collection of blood between the skull and the brain, under the thin layer of protective tissue surrounding the brain, or within the brain itself.

Expenses Associated With Living With a Traumatic Brain Injury

The lifetime cost of a traumatic brain injury ranges from roughly one hundred thousands dollars all the way up to millions. These expenses include medical care, lost wages, and lost earning capacity. They do not, however, take into account loss of joy of life, pain and suffering, or emotional distress. While a personal injury claim does not provide a medical solution for a TBI, it can help prevent economic ruin, and enable a TBI victim to receive the high quality of care they may depend on for the years to come.
