Jacksonville Man Faces Federal Charges In Capitol Riot

FedCrime3

A Jacksonville man has been officially charged for his role in the Capitol riots according to a recent newspaper article. The man is facing charges of illegally and forcibly entering a restricted area and disorderly conduct on Capitol grounds. These are the two most basic chargers that participants in the fateful riot are facing. The most severe charges include sedition and terrorism.

How Does the Prosecution Know Who Was There?

Federal prosecutors know who was there because the rioters posted images of themselves on Facebook and Instagram apparently believing that they were liberating the Capitol from an illegal occupying force. Since these people are now facing charges including terrorism and sedition, it’s just about the right time for them to begin turning on the person who they believe is responsible for their actions: Donald J. Trump.

Several rioters, including Proud Boys members, have publicly denounced Trump for “lying” to them about the election results.

Is This a Valid Defense?

Probably not. The defense for these rioters will argue that it is every American’s civic duty to defend and protect the Constitution of the United States. If they are told that the individual who was elected president was elected by fraudulent means, the defense will argue it is logical and right that citizens should do whatever is within their power to defend the American Republic. But you can’t enter federal property without permission and there is a whole set of jury instructions likely to chip away at many defense arguments.

The catch, of course, is that they rioters weren’t right and so now they are facing serious charges.

What Does This Mean for Trump?

While the impeachment is over, Donald J. Trump’s legal problems have only just begun. The Republicans in Congress never said that Trump should not be charged with crimes related to that day, they only said that impeachment was the improper forum to hold him accountable.
