Criminal Appeals & Post-Conviction Lawyer
Legal error can come in many forms but very few can result in a new trial or the charges being dismissed. If you believe in any way that a judge, prosecutor, or defense lawyer made a legal error that had a harmful effect on the ultimate result of your case contact Nicholas G. Matassini, Board Certified Criminal Trial Lawyer by the Florida Bar and AV Rated by Martindale Hubbell.
In State and Federal Courts you must file your notice of appeal or post-conviction claim within specified time frames. A delay or error in filing the notice of appeal or motion for post-conviction relief on time can result in a denial of your claim without ever getting to argue the merits of the case. Our criminal appeal lawyers will begin by reviewing your every aspect of your case and claims of legal error. Then we will personally meet with the client and his family to discuss the potential for success, the appellate path forward, and payment options.
Nicholas G. Matassini recently had a sentence vacated and remanded in a Federal maritime drug trafficking case in USA v. Victor Otero-Pomares 15-13024. Matassini was called for oral argument before the 11th Circuit Court of Appeals and successfully argued, along with co-counsel for the other convicted sailors, that the 19-year prison sentence handed down to his client, a poor Colombian fisherman with no prior record and no local ties, should be vacated. Matassini insisted all along that the trial court committed significant legal errors at sentencing.
